ACC Radio-TV-Film Equipment Use Agreement

By signing below, I acknowledge that I am checking out equipment from the Austin Community College Radio-TV-Film Department (ACC-RTF). I understand that using video production equipment—especially on location—involves certain risks. I agree to accept full responsibility for the safe and proper use of all ACC-RTF equipment signed out to me for this project, excluding normal wear and tear.

Assumption of Risk & Release of Liability

I understand and accept all risks associated with using ACC-RTF equipment. I agree to release, indemnify, defend, and hold harmless Austin Community College, including its officers, agents, and employees, from any and all claims or liabilities. This includes, but is not limited to, claims for injury, death, medical expenses, loss of income, or emotional distress that may occur now or in the future as a result of my use of ACC-RTF equipment or my failure to follow ACC-RTF policies and procedures.

Financial Responsibility for Equipment

I accept full financial responsibility for any loss, theft, or damage to ACC-RTF equipment while it is checked out in my name.

The student assumes full responsibility for all loss or damage, including but not limited to:

• Damage or loss requiring full replacement, regardless of cause
• Scratched or damaged lenses
• Unauthorized internal adjustments or repairs
• Damage caused by water or rain
• Willful or intentional misuse or loss
• Theft from any vehicle (locked or unlocked) with signs of forced entry
• Theft from a visibly open vehicle is not covered under any circumstances
• Loss or damage while equipment is in transit with a carrier
• Unexplained loss or disappearance
• Loss due to war, government action, confiscation, or seizure
• Theft not reported to the police within 48 hours
• A police report must be provided to ACC-RTF
• Loss or damage due to fraudulent or dishonest acts

Payment Terms & Replacement Fees

• If equipment is lost, the student has 7 calendar days from the scheduled check-in date to locate and return the item at no cost.
• After 7 days, the item will be considered lost and the replacement fee will be charged, even if the equipment is later found.
• If items are returned in disarray or incorrectly, there will be a $10 restocking fee
• All replacement and restocking fees must be paid in cash directly to the RTF Department.
• Failure to pay fees in a timely manner will result in loss of equipment checkout privileges for current and future ACC-RTF classes.
• Repeated loss or damage of equipment may result in suspension from ACC-RTF classes, regardless of whether fees have been paid.
• Final replacement costs will be determined by the Equipment Manager and Studio Manager based on the cost of comparable equipment from the official ACC vendor (B&H).
• ACC-RTF reserves the right to reduce replacement fees on a case-by-case basis, depending on the circumstances.
